“Justice reform has given what was expected of Albania, in terms of independence, accountability and has made a huge contribution to the progress Albania has made on its path to the EU.”
This is what the European Union Ambassador to Tirana, Silvio Gonzato stated during the discussions at the roundtable “Evaluation of Institutional Architecture for the Special Prosecution’s performance and integrity: guarantees for independence and accountability mechanisms organized by the Center for the Study of Democracy and Governance”.
The roundtable focused on presenting the findings of a study on institutional architecture, performance and integrity of the Special Prosecution (SPAK), focusing on guarantees for independence and accountability mechanisms.
“Judicial decisions have a direct impact on people’s lives. Independence without accountability increases the risk of abuse of power. Accountability without guaranteed independence leads to corruption and impunity,” said Ambassador Gonzato.
However, according to him, there is still a lot of work to do, including implementation while encouraging all relevant institutions to continue working on this purpose.
“The European Union is ready to support Albania on this important journey,” said EU Ambassador Silvio Gonzato during his speech.
Gonzato also spoke about the progress of the High Prosecutorial Council (LCP) in the evaluation of prosecutors by performance, while emphasizing that criteria such as efficiency, ethics and managerial skills should be considered structured.
He said that responsibility for accountability belongs not only to the LCP, but also to institutions such as HIDD and the School of Magistrates, which are strengthening cooperation to increase transparency and accountability in the justice system.
“As for regular reporting by justice institutions including SPAK, parliamentary procedures are clear. In addition to this election year, reporting has always been ongoing,” Gonzato said.
Of course, he added, “is the prerogative, the prerequisite of the Assembly to determine the level of commitment to these reports, which means that each year the Assembly approves resolutions that clearly show the conditions and steps to be followed in order for these institutions to make their reports.
However, Gonzato continued, “this kind of accountability cannot be to the detriment of the independence of these bodies, because the legislator and these institutions are independent and cannot be dependent on one another.” (July 11)
